These Terms and Conditions govern the provision and use of IPv4 leasing, IP resource management, routing-related support, and associated network and technical services provided by Hyper ICT Oy.

Service & Customer
1. Introduction
These Terms and Conditions (“Terms”) govern the provision and use of IPv4 leasing, IP resource management, routing-related support, and associated network and technical services provided by Hyper ICT Oy.
By requesting, ordering, purchasing, activating, using, or continuing to use our Services, the Customer agrees to be bound by these Terms.
If the Customer does not agree with these Terms, the Customer must not use the Services.
These Terms are primarily intended for business and professional customers.
2. Definitions
For the purposes of these Terms:
“Company”, “Hyper ICT”, “we”, “our”, or “us” means Hyper ICT Oy.
“Customer” means the person, company, organization, or other legal entity ordering or using the Services.
“Services” means IPv4 leasing, IP resource management, routing-related support, BGP, RPKI/ROA, registry-related assistance, network services, and any associated technical services provided by Hyper ICT.
“IP Resources” means IPv4 addresses, address blocks, prefixes, and associated Internet number resources made available for use through the Services.
“Assigned IP Resources” means IP Resources assigned or made available to a Customer under an active Service.
“Abuse” means use or activity that is unlawful, malicious, unauthorized, harmful, deceptive, abusive, or reasonably likely to create security, compliance, operational, routing, or reputational risk.
“Service Period” means the period during which a Customer is authorized to use the applicable Service.
3. Nature of the Service
Hyper ICT provides IPv4 leasing and related network services using IP resources made available through lawful resource holders, LIR arrangements, partners, or other authorized arrangements.
The Service grants the Customer a limited, temporary, revocable, and non-transferable right to use the Assigned IP Resources subject to these Terms and any specific commercial agreement between the parties.
Unless expressly agreed otherwise in writing, the Customer receives only a right of use and does not acquire ownership or title to the IP Resources.
4. No Ownership Rights
Nothing in these Terms constitutes or shall be interpreted as:
- a sale of IP Resources;
- a transfer of ownership or title;
- a permanent assignment;
- a transfer of registration rights; or
- a guarantee of permanent control over any IP Resource.
All IP Resources remain under the ownership, registration, administration, or lawful control of their respective resource holder or assigning entity.
The Customer shall not represent itself as the owner of Assigned IP Resources merely because it has been granted temporary use of them.
5. Service Orders and Customer Information
The Customer must provide accurate and sufficient information necessary for the provision of the Services.
Depending on the Service, this may include:
- Name and company information
- Billing address
- Billing contact
- Abuse contact
- Technical contact
- Email address
- Telephone or messaging contact
- Country
- RIPE organization information, where applicable
- ASN
- Upstream ASN, where applicable
- Routing requirements
- Geolocation requirements
- LOA requirements
- Intended use of the IP Resources
The Customer must ensure that information provided to Hyper ICT remains accurate and up to date.
The Customer must promptly notify Hyper ICT of material changes to its contact information, ASN, upstream provider, abuse contact, routing arrangement, or intended use.
Providing false, misleading, materially incomplete, or fraudulent information may result in refusal, suspension, or termination of Service.
6. Service Activation and Provisioning
Service activation is subject to:
- availability of suitable IP Resources;
- receipt of required Customer information;
- completion of any necessary technical or compliance review;
- payment where required;
- availability of required routing or registry arrangements; and
- acceptance of the Customer’s intended use.
Any provisioning time communicated by Hyper ICT is an estimate unless expressly guaranteed in writing.
Activation may require technical actions including RIPE Database updates, route objects, RPKI/ROA configuration, LOA issuance, routing changes, or coordination with third-party network providers.
Hyper ICT is not responsible for delays caused by incomplete Customer information, third-party providers, Internet registries, RIR systems, routing propagation, or circumstances outside its reasonable control.
7. Customer Responsibility
The Customer is fully responsible for all activities, traffic, content, services, routing behavior, and technical operations associated with the Assigned IP Resources.
This includes activity performed by:
- the Customer;
- its employees;
- contractors;
- clients;
- end users;
- downstream users; or
- any other person or system to whom the Customer provides access.
The Customer is responsible for maintaining appropriate technical and security controls and for ensuring that all use of the Assigned IP Resources complies with these Terms.
The Customer remains responsible for its Assigned IP Resources even where prohibited activity is performed by one of its customers, end users, or other authorized users.
Acceptable Use & Compliance
8. Lawful Use Only
The Services may be used only for lawful purposes and in compliance with applicable laws and regulations.
The Customer must comply with, where applicable:
- Finnish law;
- European Union law;
- telecommunications and Internet regulations;
- intellectual property laws;
- sanctions and export-control requirements;
- data protection requirements; and
- applicable network security and abuse-handling requirements.
The Customer must not knowingly use or permit the Services to be used for unlawful, malicious, abusive, deceptive, harmful, or unauthorized activities.
9. Sanctions and Restricted Activities
The Customer must not use the Services in violation of sanctions, restrictive measures, or export-control requirements applicable to Hyper ICT or the relevant transaction.
The Customer may not knowingly use the Services directly or indirectly:
- for sanctions evasion;
- for prohibited transactions involving sanctioned persons or entities;
- for activities prohibited under applicable export-control rules; or
- in circumstances that would cause Hyper ICT to violate applicable sanctions or regulatory obligations.
Hyper ICT may request information reasonably necessary to perform compliance checks.
Where Hyper ICT reasonably determines that providing or continuing a Service creates a sanctions, regulatory, AML, export-control, or material compliance risk, Hyper ICT may refuse, restrict, suspend, or terminate the affected Service.
10. Spam and Bulk Email
Use of Assigned IP Resources for spam or unsolicited bulk communications is prohibited.
Prohibited activity includes:
- unsolicited bulk email;
- spam;
- mass mailing without appropriate recipient consent;
- automated email blasts;
- snowshoe spam;
- rotating IP addresses to avoid reputation controls;
- deceptive email campaigns; and
- email activity reasonably likely to generate significant abuse complaints or blacklist listings.
Bulk email or high-volume email delivery is not permitted unless expressly approved by Hyper ICT in writing.
Where email-related use has been approved, the Customer remains responsible for compliance with applicable laws, consent requirements, industry practices, and these Terms.
11. Email System Requirements
Where email-related use is expressly approved, the Customer must maintain appropriate email configuration and abuse controls.
This may include, where applicable:
- reverse DNS;
- SPF;
- DKIM;
- DMARC;
- appropriate HELO/EHLO configuration;
- functional abuse contacts;
- consent-based recipient management;
- suppression and unsubscribe mechanisms; and
- reasonable list hygiene.
Hyper ICT may withdraw approval for email-related use where the activity creates material abuse, blacklist, security, or reputational risk.
12. Hacking and Unauthorized Access
The Services must not be used to conduct or facilitate unauthorized access to systems, networks, accounts, or data.
Prohibited activities include:
- hacking;
- credential attacks;
- brute-force attacks;
- unauthorized exploitation;
- unauthorized penetration testing;
- account takeover attempts;
- bypassing security controls;
- privilege escalation;
- credential harvesting; and
- exploitation of known or unknown vulnerabilities without authorization.
Authorized security testing performed with clear permission from the relevant system owner is not prohibited solely because it involves legitimate security testing techniques.
13. Network Attacks
The Customer must not use the Services to conduct, facilitate, support, or knowingly participate in network attacks.
This includes:
- DDoS attacks;
- DoS attacks;
- reflection or amplification attacks;
- malicious flooding;
- protocol abuse;
- deliberate service disruption;
- malicious IP spoofing;
- malicious packet generation; and
- command-and-control activity.
Such conduct may result in immediate protective action.
14. Scanning, Enumeration and Reconnaissance
Unauthorized scanning or reconnaissance is prohibited.
This includes unauthorized:
- port scanning;
- vulnerability scanning;
- mass Internet scanning;
- service probing;
- account enumeration;
- credential probing; and
- systematic reconnaissance.
Legitimate scanning or security testing performed with appropriate authorization may be permitted where it does not create material risk to Hyper ICT, its IP resources, or third parties.
15. Malware, Botnets and Malicious Software
The Services may not be used to knowingly host, distribute, control, transmit, or facilitate:
- malware;
- ransomware;
- spyware;
- trojans;
- viruses;
- worms;
- malicious scripts;
- botnets;
- command-and-control infrastructure;
- droppers; or
- exploit kits.
The Customer must take reasonable action to secure compromised systems and stop malicious activity when notified.
16. Phishing, Fraud and Deceptive Conduct
The Services may not be used for phishing, fraud, impersonation, scams, credential theft, or other deceptive activity.
This includes:
- credential harvesting;
- fake login pages;
- malicious impersonation;
- payment fraud;
- invoice fraud;
- social engineering infrastructure;
- deceptive redirects;
- malicious landing pages; and
- fake financial or support services.
Credible evidence of such activity may result in immediate protective action.
17. Copyright and Intellectual Property
The Customer must comply with applicable copyright, trademark, and intellectual property laws.
Assigned IP Resources must not knowingly be used primarily to facilitate unlawful distribution of copyrighted or otherwise protected material.
Where Hyper ICT forwards a credible infringement complaint to the Customer, the Customer must investigate it promptly and take appropriate action where infringement is confirmed.
Repeated infringement or failure to address credible complaints may result in suspension or termination.
18. Illegal and High-Risk Activities
The Services must not be used for activities that are illegal or create unacceptable security, compliance, operational, or reputational risk.
Examples may include:
- fraud;
- phishing;
- malicious infrastructure;
- criminal marketplaces;
- distribution of stolen data;
- unlawful surveillance;
- illegal financial schemes;
- unlawful gambling activities; and
- infrastructure primarily intended to facilitate criminal activity.
Hyper ICT may assess such risks based on available technical information, credible reports, applicable law, and the circumstances of the Service.
Routing & IP Resources
19. Routing and BGP Restrictions
Assigned IP Resources may be announced only through routing arrangements authorized by Hyper ICT and the applicable resource holder.
The Customer must not:
- originate unauthorized routes;
- announce resources through unauthorized ASNs;
- intentionally create conflicting routing information;
- engage in route hijacking;
- bypass agreed routing arrangements; or
- continue announcing Assigned IP Resources after authorization has ended.
The Customer must promptly withdraw any route when requested by Hyper ICT following termination, expiry, security action, or an authorized routing change.
Unauthorized routing may result in immediate technical protective action.
20. RPKI and ROA
Hyper ICT or the applicable resource holder retains authority over RPKI and ROA records associated with Assigned IP Resources.
Depending on the Service and routing arrangement, Hyper ICT may:
- create ROAs;
- modify ROAs;
- revoke ROAs;
- change authorized origin ASNs;
- change maximum prefix lengths;
- remove authorizations; or
- use AS0 or other protective configurations where appropriate.
ROA configurations may be changed where necessary following Service termination, expiry, routing changes, unauthorized announcements, abuse incidents, or security concerns.
The Customer does not acquire a permanent right to any particular ROA configuration.
21. RIPE Database and Registry Information
Where necessary for the Service, Hyper ICT may create, modify, maintain, or request changes to RIPE Database or other Internet registry objects relating to Assigned IP Resources.
These may include:
- inetnum information;
- organization references;
- abuse contacts;
- route objects;
- technical contacts; and
- other resource-related information.
The Customer must provide accurate information required for such records.
Hyper ICT may remove, replace, or modify Customer-related registry information when the Service ends or where necessary to maintain accurate resource records.
22. Blacklists and Reputation
The Customer is responsible for using Assigned IP Resources in a manner that does not materially damage their reputation.
Hyper ICT may consider reports or listings from established security, abuse, anti-spam, threat intelligence, or reputation services, including services such as Spamhaus and comparable organizations.
A listing or report does not automatically require termination in every case.
However, where Hyper ICT reasonably determines that a listing, report, complaint, pattern of activity, or related evidence creates a material abuse, security, compliance, operational, or reputational risk, Hyper ICT may take protective action.
Such action may include:
- requesting mitigation;
- suspending affected resources;
- withdrawing routing support;
- modifying or revoking ROAs;
- setting an origin authorization to AS0 where appropriate; or
- terminating the affected Service.
Where immediate action is reasonably necessary to protect IP resources, network infrastructure, third parties, or Hyper ICT’s reputation, action may be taken without prior notice.
23. Abuse Complaints
The Customer must maintain a working abuse contact and cooperate with legitimate abuse investigations.
Unless a shorter period is reasonably required because of the seriousness of an incident, the Customer must respond to an abuse notice from Hyper ICT within 24 hours.
The Customer may be required to:
- investigate the reported activity;
- stop confirmed abusive activity;
- secure compromised systems;
- identify mitigation measures;
- provide relevant technical information; and
- confirm corrective action.
A response does not automatically mean that the matter has been adequately resolved.
Hyper ICT may take protective action where:
- the Customer fails to respond;
- mitigation is inadequate;
- abuse continues;
- repeated complaints occur;
- serious malicious activity is detected; or
- immediate intervention is reasonably necessary.
24. Protective Actions
Where Hyper ICT reasonably determines that urgent action is necessary to protect IP Resources, network integrity, third parties, legal compliance, or resource reputation, Hyper ICT may take immediate technical action.
This may include:
- route withdrawal;
- ROA modification or revocation;
- AS0 authorization where appropriate;
- suspension;
- traffic restriction;
- registry changes; or
- termination.
Hyper ICT is not required to maintain active routing while investigating credible abuse, unauthorized routing, malicious activity, or significant security risk.
25. IP Reputation and Deliverability
Unless expressly agreed otherwise in writing, Hyper ICT does not guarantee:
- any particular IP reputation score;
- permanent blacklist-free status;
- email inbox placement;
- email deliverability;
- acceptance by Google, Microsoft, Yahoo, or other third parties;
- acceptance by reputation services;
- suitability for a particular third-party platform; or
- uninterrupted acceptance of an IP address by external networks.
Internet reputation and third-party acceptance may change independently of Hyper ICT.
26. Subleasing, Resale and Transfer
The Customer may not resell, sublease, assign, transfer, or commercially redistribute Assigned IP Resources as a separate resource without prior written approval from Hyper ICT.
Where resale or downstream use has been expressly approved, the Customer remains responsible for compliance with these Terms by its downstream users.
Approval of downstream use does not transfer Hyper ICT’s contractual relationship or obligations to the downstream user unless expressly agreed in writing.
27. Testing Periods
Where Hyper ICT offers a test period for IP Resources, the test is provided solely for technical and reputation evaluation before activation of the regular Service.
The Customer must comply with these Terms during the test period.
Testing does not guarantee future availability of the tested resources unless they are subsequently reserved or activated by Hyper ICT.
Hyper ICT may terminate a test immediately where abuse, unauthorized routing, malicious activity, or material risk is detected.
Billing & Termination
28. Fees and Payment
Unless otherwise agreed in writing, Services are provided on a prepaid basis.
The Customer must pay invoices in full by the due date stated on the invoice.
Pricing may depend on:
- IP block size;
- Service Period;
- routing requirements;
- additional network services; and
- specific commercial arrangements.
Bank transfer and other payment methods accepted by Hyper ICT may be used as made available to the Customer.
Any bank, currency-conversion, intermediary, or payment-provider charges not expressly included in the agreed price are the Customer’s responsibility.
29. Late Payment
If an invoice remains unpaid for more than three days after its stated due date, Hyper ICT may suspend or restrict the affected Service.
This may include:
- suspension of IP Resources;
- removal of routing support;
- modification or removal of technical configurations; or
- termination of the affected Service.
Hyper ICT may restore the Service following receipt of payment where the resources remain available and restoration is technically and commercially feasible.
30. Renewals and Cancellation
Unless otherwise agreed in writing, the applicable billing period, renewal arrangement, and cancellation conditions are those stated in the Customer’s quotation, invoice, order, or other commercial agreement with Hyper ICT.
Customers wishing to discontinue a Service should notify Hyper ICT before the next applicable billing period.
Cancellation does not relieve the Customer of amounts already due.
Following expiry or cancellation, the Customer must stop using and announcing the Assigned IP Resources.
Hyper ICT may remove routing, ROA, registry, LOA, or other technical authorizations associated with the terminated Service.
IP Resources released following cancellation or expiry may be reassigned and are not guaranteed to remain available to the former Customer.
31. Refunds
Fees for activated Services are generally non-refundable unless otherwise agreed in writing or required by applicable law.
No refund or compensation is normally payable where suspension or termination results from:
- confirmed abuse;
- spam;
- malicious activity;
- unauthorized routing;
- material breach of these Terms;
- sanctions or compliance restrictions attributable to the Customer;
- non-payment; or
- other prohibited activity attributable to the Customer or its users.
This does not limit any rights that cannot lawfully be excluded.
32. Suspension and Termination
Hyper ICT may suspend, restrict, or terminate a Service where it reasonably determines that:
- the Customer has materially breached these Terms;
- credible abuse or malicious activity exists;
- unauthorized routing exists;
- continued Service creates material security or compliance risk;
- the Customer fails to address abuse appropriately;
- payment remains overdue;
- the Customer has provided materially false information;
- continued Service creates significant risk to IP resource reputation; or
- Hyper ICT is legally or technically unable to continue providing the Service.
Where reasonably possible and appropriate, Hyper ICT may provide notice or an opportunity to remedy the issue.
Immediate action may nevertheless be taken where necessary to protect network security, IP Resources, third parties, regulatory compliance, or resource reputation.
33. Effects of Termination
Upon termination or expiry of a Service:
- the Customer’s authorization to use the Assigned IP Resources ends;
- the Customer must stop originating or announcing the resources;
- any LOA or routing authorization relating to the Customer may cease to be valid;
- Hyper ICT may remove or modify route objects;
- Hyper ICT may revoke or modify ROAs;
- Hyper ICT may modify registry information;
- the resources may be reassigned.
Continued use or announcement after authorization has ended is prohibited.
34. Monitoring and Investigation
Hyper ICT may monitor service-related technical indicators where reasonably necessary for:
- routing integrity;
- abuse prevention;
- blacklist and reputation monitoring;
- network security;
- fraud prevention;
- operational security; and
- compliance with these Terms.
Hyper ICT may investigate suspicious activity and request relevant explanations, logs, technical information, or mitigation evidence from the Customer.
The Customer must reasonably cooperate with such investigations.
Monitoring under this section does not mean that Hyper ICT has an obligation to monitor all Customer traffic or detect every violation.
Availability & Liability
35. Third-Party Infrastructure and Dependencies
The Services may depend on systems or services operated by third parties, including:
- RIRs and Internet registries;
- upstream network providers;
- transit providers;
- hosting providers;
- routing infrastructure;
- RPKI infrastructure;
- DNS infrastructure; and
- other Internet service providers.
Hyper ICT does not control all such systems and cannot guarantee their uninterrupted operation.
Changes, outages, policies, or technical actions by third parties may affect the Services.
36. Service Availability
Hyper ICT will use commercially reasonable efforts to provide the Services as agreed.
Unless a specific Service Level Agreement has been expressly agreed in writing, the Services are provided without a guarantee of uninterrupted or error-free availability.
Temporary interruption may occur due to:
- maintenance;
- routing changes;
- third-party failures;
- Internet outages;
- security incidents;
- registry issues;
- emergency protective actions; or
- circumstances outside Hyper ICT’s reasonable control.
37. Force Majeure
Hyper ICT shall not be liable for failure or delay in performing its obligations where caused by circumstances beyond its reasonable control.
Such circumstances may include:
- Internet or telecommunications failures;
- power failures;
- major network outages;
- cyberattacks;
- acts of government or regulatory authorities;
- war or civil disturbance;
- natural disasters;
- fire;
- strikes;
- failure of critical third-party infrastructure; or
- other comparable events beyond reasonable control.
Hyper ICT will use reasonable efforts to mitigate the effects of such events where practical.
38. Limitation of Liability
To the maximum extent permitted by applicable law, Hyper ICT shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from or related to the Services.
This includes, where legally permitted:
- loss of profits;
- loss of revenue;
- loss of business opportunities;
- loss of goodwill;
- loss of data;
- service interruption;
- routing interruption;
- blacklist-related consequences; and
- actions or restrictions imposed by third parties.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
39. Indemnification
To the extent permitted by applicable law, the Customer agrees to indemnify and hold Hyper ICT harmless from third-party claims, losses, liabilities, damages, and reasonable costs arising from:
- the Customer’s unlawful use of the Services;
- abuse originating from systems under the Customer’s responsibility;
- spam or malicious activity;
- copyright or intellectual property infringement;
- unauthorized routing;
- network attacks;
- fraudulent activity; or
- material violation of these Terms.
This provision applies to the extent the relevant claim or loss is attributable to the Customer or persons for whom the Customer is responsible.
Legal & Administrative
40. Privacy and Data Protection
Personal data processed in connection with the Services is handled in accordance with Hyper ICT’s Privacy Policy and applicable data protection law.
The Privacy Policy is available on the Hyper ICT website.
Where the Customer provides personal information relating to employees, technical contacts, downstream users, or other individuals, the Customer is responsible for ensuring that it is lawfully permitted to provide such information.
41. Notices and Communications
Hyper ICT may communicate Service-related notices through the contact details provided by the Customer.
Depending on the circumstances, communications may be sent by:
- email;
- invoice or billing communication;
- support communication; or
- other agreed business communication channels.
The Customer is responsible for maintaining current and functional contact information.
Urgent abuse, security, routing, or compliance communications may be sent to the Customer’s designated technical or abuse contacts.
42. Assignment
The Customer may not assign or transfer its rights or obligations under the Service to another party without prior written consent from Hyper ICT.
Hyper ICT may assign or transfer its rights or obligations where reasonably necessary in connection with a corporate restructuring, transfer of business, change of service provider, resource-holder arrangement, or similar legitimate business purpose, subject to applicable law.
43. No Waiver
Failure by Hyper ICT to enforce any provision of these Terms on one occasion does not constitute a waiver of that provision or the right to enforce it in the future.
Any waiver must be expressly agreed in writing.
44. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or limited to the minimum extent necessary, and the remaining provisions shall continue in effect to the extent permitted by law.
45. Entire Agreement
These Terms, together with the applicable quotation, order, invoice, Service agreement, Privacy Policy, and any other terms expressly incorporated into the Customer’s agreement, constitute the agreement governing the relevant Service.
Where a separately signed written agreement expressly conflicts with these Terms, the expressly agreed provision of the signed agreement will prevail for the relevant subject matter.
46. Survival
Provisions that by their nature are intended to continue after termination shall survive termination or expiry of the Service.
This includes, where applicable, provisions concerning:
- outstanding payments;
- intellectual property;
- unauthorized post-termination use;
- limitation of liability;
- indemnification;
- confidentiality obligations separately agreed;
- dispute resolution; and
- governing law.
47. Amendments
Hyper ICT may update these Terms from time to time.
Updated Terms will be published on the Hyper ICT website with an updated effective or revision date.
For material changes affecting an active Service, Hyper ICT may provide additional notice where reasonably appropriate or legally required.
Continued use of the Service following the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by applicable law.
48. Governing Law and Jurisdiction
These Terms and the Services shall be governed by the laws of Finland, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts of Finland, unless mandatory applicable law requires otherwise.
